Expungement Underage Drinking Driving Hennepin County District Court

Client sought to expunge a conviction for Underage Drinking and Driving.  The District Court Referee denied the expungement request and ruled that Underage Drinking and Driving could not be expunged because it was similar to a DWI.  Attorney Christopher Grove appealed the denial to the Minnesota Court of Appeals which reversed and determined that not only could Underage Drinking and Driving be expunged but so could a DWI conviction.  Client was able to obtain expungement.

Felony Possession of Pornographic Images - All Charges Dismissed Dakota County District Court

Client had obtained erotic images from the Internet that the BCA determined did not constitute child pornography.  Despite this the local police obtained a search warrant and the County Attorney charged client with multiple felonies.  Attorney Christopher Grove challenged the issuance of the Search Warrant.  The Judge determined that the police officer intentionally misled the issuing Judge regarding the images and if the police had truthfully provided the Court with the information and conclusions of the BCA agent no warrant would have been issued.  All charges were dismissed.

Felony Fleeing Charge Dismissed Dakota County District Court

Felony fleeing charges were filed against client after a Minnesota State Trooper claimed our client’s motorcycle failed to stop for a suspected equipment violation.  Client was wearing a full-face helmet and never saw or heard the trooper’s lights or siren.  Client lost control of the motorcycle and crashed on a curve.  He was then arrested at gunpoint.  Attorney Christopher Grove obtained the squad video and police reports and filed a motion to challenge probable cause.  The court dismissed all charges.  

Felony Riot Charge Dismissed Dakota County District Court

Client was charged with felony riot after police responded to a fight that broke out in a parking lot.  The State attempted to count the client’s girlfriend as part of a group of three or more people assembled together who engaged in a riot.  The girlfriend had been assaulted by another party and the police reports identified her as a victim.  Attorney Christopher Grove argued that the State should not be able to count a victim as part of the group.  The court agreed and dismissed the charge.

Felony Assault and Riot Not Guilty Jury Verdict Dakota County District Court

Client was charged with Felony Assault and Riot following a bar fight.  An off-duty bouncer started a fight after seeing his ex-girlfriend talking with our client in the bar.  The bouncer lost the fight and suffered a broken jaw.  The jury deliberated less than 2 hours before returning Not Guilty verdicts on all counts.

Test Refusal License Revocation Rescinded – Forfeited Vehicle returned Goodhue County District Court

Client was arrested on suspicion of drunk driving.  Client was cooperative with the police but failed a PBT and field sobriety tests.  At the police station client agreed to take a breath test and provided one sample of breath that was well over the legal limit.  However, despite blowing a sufficient amount of air into the breath test machine the machine reported the second test as deficient.  The State alleged this constituted a refusal.  After Attorney Christopher Grove’s cross examination of the police officers the court overturned the revocation and reinstated the client’s driver’s license.  As a result, The Grove Law Firm was able to convince the State to abandon their attempt to forfeit the client’s vehicle and return it. 

Felony Criminal Sexual Conduct Not Guilty Jury Verdict Scott County District Court

Client was accused of sexual assault involving a child. There had been no contact between our client and the accuser for the past 20 years. Because the alleged victim was a minor the Statute of Limitations allowed the prosecutor to bring charges. Attorney Christopher Grove hired a private investigator who gained access to witnesses and discovered evidence that contradicted the allegations.  The Jury found our client not guilty of all charges.

Felony Second Degree Assault, Threats of Violence Not Guilty Verdict Dakota County District Court

Client was at a movie theater with friends when a dispute arose.  Client went to leave and drive away.  Client was confronted in the vehicle and the State accused our client of using the vehicle to assault others.  The State refused to call the investigating officer at trial because the officer had information favorable to the defense.  Attorney Christopher Grove was able to subpoena the officer and elicit the favorable testimony resulting in a Not Guilty verdict on all charges.

Felony Theft by Swindle Not Guilty Verdict Hennepin County District Court

The State charged our clients with theft as a result of merchandise returns made to a national retailer.  Because our client’s had backgrounds in Law Enforcement the prosecution held pre-trial press conferences where the County Attorney made inaccurate claims regarding the evidence.  Attorney Christopher Grove obtained records and evidence establishing no crime was committed.  Attorney Grove was able to get State’s witnesses to admit in court that no crime took place and Not Guilty Verdicts were returned on all charges.  The County Attorney was required to delete the press statement.

Felony 4th Degree Assault Obstruction of Justice with Force Not Guilty Jury Verdict Hennepin County District Court

The State charged our client with assaulting a police officer and obstruction resulting in substantial bodily harm.  Police working an off- duty security detail were asked to remove our client from the property.  When our client went to walk away police tried to grab onto our client and everyone fell to the ground.  Attorney Christopher Grove obtained a Court Order requiring the State to disclose prior medical injuries sustained by the officer and challenged the causation of the injuries.  Without calling a single witness for the defense the Jury found our client Not Guilty of all charges.

Felony Criminal Sexual Conduct Not Guilty Jury Verdict Hennepin County District Court

The State charged our client with Criminal Sexual Conduct in a case that would have resulted in a substantial prison sentence if convicted.  Attorney Christopher Grove conducted a detailed analysis of the digital evidence and discovered information that was favorable to the defense.  The State sent two excellent Prosecutors to try the case.  After a long and challenging trial the Jury returned a Not Guilty Verdict in less than one hour.

Felony Terroristic Threats Steele County Minnesota, Gross Misdemeanor Harassment 

Client was charged the crimes of felony terroristic threats and gross misdemeanor harassment.  Attorney Christopher Grove was retained and a not guilty plea was entered.  Attorney Grove challenged the sufficiency of the evidence and the court dismissed the felony charge.  A Jury Trial was held on the harassment charge and at the close of the State’s case the Judge granted Mr. Grove’s motion for judgment of acquittal and all charges were dismissed. 

Felony Theft by Swindle Scott County Minnesota

Grand Jury Indictment 

Client, a member of the City Council was indicted by a Grand Jury and charged with the crimes of felony theft by swindle and misconduct of a public official.  Attorney Christopher Grove demanded a contested omnibus hearing and filed a motion to dismiss all charges.  Following a contested hearing the trial Judge granted the motion to dismiss and vacated the Grand Jury indictment resulting in the dismissal of all charges.  The State appealed the dismissal and Mr. Grove defended the client at the Minnesota Court of Appeals where a three-judge panel affirmed the dismissal of all criminal charges and ordered the State to pay the attorney’s fees and costs associated with the appeal. 

Domestic Assault Scott County Minnesota 

Client was charged with the crime of domestic assault.  Attorney Christopher Grove filed a notice of self defense and a motion to dismiss all charges.  The court ruled that the client acted in self-defense and granted the motion dismissing all charges. 

Domestic Assault Isanti County Minnesota  

Client was charged with the crime of domestic assault.  Attorney Christopher Grove filed a motion to dismiss.  The court determined there was insufficient evidence that a crime was committed and dismissed all charges. 

Solicitation of Prostitution Ramsey County Minnesota 

Client was charged with the crime of solicitation of prostitution based upon conversations with an undercover police officer.  Attorney Christopher Grove entered a not guilty plea on behalf of the client and demanded a trial.  Mr. Grove successfully cross-examined the police officer and the client was acquitted of all charges. 

Expungement – Theft Hennepin County Minnesota 

Client sought to expunge a theft conviction in Hennepin County, MN.  Attorney Christopher Grove filed a Petition to seal all records.  Over the State’s objection Mr. Grove was successful in obtaining a favorable order from the Court. 

Cash Forfeiture Dakota County Minnesota 

Client was arrested for drug possession and the Drug Task Force seized all cash held by client and sought to forfeit the cash as proceeds from illegal drug transactions.  Attorney Christopher Grove challenged the basis for the forfeiture and following a contested hearing the court ordered the return of all cash and granted a judgment against the Drug Task Force for the costs of the court proceeding. 

Criminal Sexual Conduct Goodhue County Minnesota 

Client was charged with criminal sexual conduct following a complaint raised during a family/custody/visitation dispute.  Attorney Christopher Grove demanded a contested omnibus hearing and filed a motion to dismiss all charges.  Following Mr. Grove’s cross-examination of the complaining witness the Court issued an Order dismissing all charges. 

Criminal Sexual Conduct 1st Degree Dakota County Minnesota 

Client was convicted of a criminal sexual conduct offense that carried a recommended guideline sentence of 120 months in prison.  Attorney Christopher Grove presented expert testimony at the sentencing hearing resulting in a downward departure with no prison time. 

Criminal Vehicular Operation Dakota County Minnesota

Client was charged with felony criminal vehicular operation as a result of a vehicle/pedestrian accident. Mr. Grove discovered that the State’s investigators actually concluded that the pedestrian was at fault for the collision and the felony charge was dismissed with no jail time. 

Criminal Vehicular Operation Anoka County Minnesota

Client was charged with felony criminal vehicular operation.  Following a contested omnibus hearing the State agreed to dismiss the felony charge and client served no jail time. 

DWI and Implied Consent Dakota County Minnesota 

Client was charged with driving while intoxicated and the State revoked his driver’s license.  Mr. Grove filed a Petition for Judicial Review of the driver’s license revocation.  Following Mr. Grove’s cross-examination of the police officer the court determined that the officer had a mistaken belief that an offense was committed and ordered the State to reinstate the driver’s license.  The prosecution dismissed the criminal DWI charges. 

Driving under the Influence Dakota County Minnesota 

Client was charged with driving under the influence of alcohol.  Attorney Christopher Grove filed a motion to dismiss all criminal charges.  Following Mr. Grove’s cross examination of the police officer the Court determined that there was no probable cause for the client’s arrest and dismissed all criminal charges. 

Terroristic Threats Dakota County, Minnesota 

Client was charged with felony terroristic threats.  Attorney Christopher Grove filed a motion to dismiss.  Following a contested omnibus hearing the court dismissed the felony charge.
